ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. THE PREVENTION OF CRIME & DISORDER
CCTV
a) The premises shall install and maintain a CCTV system with a minimum of 5 cameras
b) The CCTV system shall have sufficient hard drive storage capacity to store a minimum of 31 days.
c) The CCTV system shall be capable of obtaining clear facial recognition images and a clear head and shoulders image of every person entering or leaving the premises at each exit and entrance point.
d) The Designated Premises Supervisor will ensure that the CCTV system is checked at least once every week. This check shall include the operation of the cameras, the recording facilities, the facilities for providing footage and the accuracy of the time and date. A written record of these checks to be kept on the premises and made available to a police constable within a reasonable time upon request.
e) Only nominated staff shall be trained in the operation of the CCTV system to ensure rapid data retrieval and downloads of footage can be provided to the Police and the Local Authority Officer upon reasonable request in accordance with the Data Protection Act.
f) CCTV shall be continually recording during licensable hours.
g) In the event of a failure of the CCTV system for any reason, a record of the failure shall be recorded in the premises Incident log and immediate steps will be made to rectify the problem.
h) The CCTV system shall provide a clear head and shoulders view to an evidential quality on the customers entry.
i) Record footage shall be provided within a reasonable time to a police constable upon request.
j) Such footage shall be provided in a viewable format and to include any software etc. that is required to view the footage.
k) A contact number for the Designated Premises Supervisor shall be available on the premises when not on duty.
l) Relevant staff shall be given the appropriate training on the legislation relating to alcohol and diners under the age of 18.
m) An Alcohol register containing all the names of all persons who are authorised to sell alcohol on the premises shall be completed and kept at the premises for a minimum of 12 months.
n) No open vessels are allowed to be taken outside of the ON sales area at any time.
o) No sales of singles cans of beers, ciders or lagers are to be sold at any time (OFF Sales).
p) No single bottles of Beers ciders or lagers (Under 1 litre capacity) are to be sold at any time (OFF Sales).
q) No Beers, ciders, or lagers over 5.5% ABV to be sold at any time (OFF Sales).
r) No Alcopops to be sold at any time (OFF Sales).
s) Patrons are not permitted to remove open containers of alcohol from the premises save for consumption in any authorised delineated external area.
2. PUBLIC SAFETY
None
3. PREVENTION OF PUBLIC NUISANCE
a) Prominent, clear and legible notices shall be displayed at the exit and in key areas, requesting the public to respect the needs of the local residents and to leave the premises and the area quickly and quietly.
b) All residents in the direct vicinity of the premises shall be given the number of the Duty Manager in case of any issues regarding noise nuisance.
c) No waste to be disposed of between the hours of 22:00 and 08:00 every day.
d) The hours of deliveries and supplies to the premises and collection of refuse shall be restricted to 09:00 and 18:00 hours Monday to Saturday with no such operations on Sundays and Bank Holidays.
4. THE PROTECTION OF CHILDREN FROM HARM
a) A Challenge 25 policy shall operate. Such policy shall be written down and kept at the premises. The policy shall be produced on demand of the police or an ‘authorised person’ (as defined by section 13 of the licensing act 2003) or an authorised trading standards officer the local authority/council.
b) Prominent, clear and legible Challenge 25 signage shall also be displayed at all entrances to the premises as well as at, at least one location behind any counter advertising the scheme operated.
c) The only forms of ID that shall be accepted (at the discretion of the Management) as proof of age are a valid passport, a valid photographic driving licence, a PASS approved proof of age card, HM Services Warrant Card or other reliable photo ID (that has been approved for acceptance by the Police or an Officer of the Local Authority)
d) Proxy signs shall be fitted near to all alcohol P.O.S positions warning people not to buy alcohol for children.
e) The Designated Premises Supervisor or Premises Licence Holder shall operate and maintain an up-to-date Register of Refusals of Sale of Alcohol, indicating the date, time and reason for refusal including a description of the people who have been unable to provide required identification to prove their age. Such records shall be kept for a period of 12 months and will be collected by the designated premises supervisor and shall be made available for inspection by Local Authority Officers and the Police on request. The DPS or other responsible person shall check and sign the register once a week. Alternatively, an electronic point of sale refusals log shall be kept.
f) A documented training programme, in Challenge 25, shall be introduced for all staff in a position to sell, serve or deliver alcohol. A written record for each member of staff shall be kept of the content of such training and shall be made available for inspection at the request of Local Authority Officers and Police.
g) The DPS or Premises Licence Holder shall conduct six monthly training reviews with all members of staff authorised to sell, serve or deliver alcohol in order to reinforce the training and to promote best practice. A written record for each member of staff shall be kept of the content of such reviews and shall be made available for inspection at the request of Local Authority Officers and Police. As part of their training all staff are to undertake a short test or quiz as part of their training and a record of this to be kept.
