ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. THE PREVENTION OF CRIME & DISORDER
CCTV
a) The CCTV system should be designed and installed in accordance with Cheshire Constabulary’s CCTV guidance document called “CCTV in Licensed Premises - an Operational Requirement.”
b) The Images recorded by the CCTV system shall be retained in an unedited format for a period of not less than 30 days.
c) CCTV equipment shall be maintained in good working order in accordance with the manufacturer’s instructions and shall be operational at all times when a licensable activity takes place on the premises.
d) Designated supervisors will need to demonstrate that their CCTV system complies with their Operational requirements. They will need to be able to demonstrate the following: -
• Recordings are fit for their intended purpose,
• Good quality images are presented to the officer in a format that can be replayed on a
• standard computer
• The supervisor has an understanding of the equipment/training,
• Management records are kept,
• Maintenance agreements and records are maintained,
• Data Protection principles and signage are in place.
e) Any person who is employed to have operational responsibility for the premises, must be trained in the use of any such CCTV equipment.
f) That person(s) must, upon reasonable request and as soon as practicable, make CCTV images available to a Police Officer or other Authorised Officer.
g) When a request for CCTV is made by the Police, any footage should be uploaded using a secure link provided by the officer which will be sent to the appropriate person via an email or text message.
h) A CCTV monitor shall be positioned in an area showing real time footage from all cameras to allow members of staff to monitor any activities. This monitor must be fully functional at all times the premises is open to the public.
i) Only staff members, officers from Responsible authorities and persons carrying out maintenance/safety checks are permitted to be behind the counter, in the food preparation and storage areas. No customers to be allowed behind the counter at any time.
j) A written record shall be kept on the premises by the PLH of every person employed on the premises in a register for that purpose. That record shall contain the following details:
· time/date he/she starts and finishes each duty,
· name, address and date of birth of each member of staff (including delivery drivers)
· a record of vehicle registration numbers used in any delivery service and copy of vehicle insurance.
k) The premises licence holder when employing staff members will carry out checks on the person to ensure that they have the right to live and work in the UK, any Concerns regarding a potential employee are to be brought to the attention of the appropriate authorities.
l) All checks made and along with the outcome will be documented in an appropriate book or spreadsheet. Staff will only be employed if they have the correct entitlement to live/work in the UK.
m) The documented checks will be made available for inspection at the request of Local Authority Officers, Police and Immigration.
n) The premise licence holder shall ensure that CCTV with the data for 30 days and shall will have a incident book for the recording of all incidents also with a manager on all shifts
2. PUBLIC SAFETY
a) CCTV shall cover the customer area and a manager shall be on night shifts to monitor the public safety.
3. PREVENTION OF PUBLIC NUISANCE
a) There shall be no load music playing in the restaurant.
b) Notices will be positioned at the exits to the building requesting customers to leave in a quiet manner.
c) The exterior of the building shall be cleared of litter at regular intervals.
d) The emptying of bins into skips, the removal of refuse from the building, and refuse collections will not take place between 11pm and 7am.
4. THE PROTECTION OF CHILDREN FROM HARM
