ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
THE PREVENTION OF CRIME AND DISORDER
1) CCTV is installed in the premises and shall comply with the Cheshire Constabulary Operational guidelines for CCTV (Document Dated April 2013).
2) Where CCTV equipment is fitted, it shall be maintained in good working order in accordance with the manufacturer’s instructions and shall be operational at all times when a licensable activity is taking place on the premises.
3) A written record shall be kept of images that are recorded by CCTV and shall include details of the recording medium used, the time and date recording commenced and finished. The record shall identify the person responsible for the recording and shall be signed by him/her. Where the recording is on a removable medium (i.e. CD, Flash card, USB etc.) a secure storage system to store those recording mediums shall be provided.
4) CCTV images shall be made available to the Police or an Authorised Officer of the Council on request for criminal prevention/detection purposes. The Premises Licence Holder shall ensure that there are sufficient staff trained on the premises who can download CCTV images at the time of a request to maximise the effectiveness of any police enquiry to detect and prosecute offenders.
5) Only staff members, officers from Responsible Authorities and persons carrying out maintenance/safety checks are permitted behind the counter, in the food preparation and storage areas. No customers to be allowed behind the counter at any time.
6) The Premises Licence Holder, when employing staff, will carry out checks on the person(s) to ensure that they have the right to live and work in the UK. Any concerns regarding a potential employee are to be brought to the attention of the appropriate authorities.
7) A written record shall be kept on the premises by the Premise Licence Holder of every person employed to work on the premises in a register for that purpose. That record shall contain the following details: date he/she began employment, and the date he/she left employment along with their name, address and date of birth.
8) All checks made and the outcome will be documented in this record which will be made available for inspection at the request of a Police Officer or an Authorised Officer of the Council.
9) The Premise Licence Holder shall keep a log of all incidents that occur on the premises while it is open for licensable activity. That log to be available on request for inspection by an Authorised Officer of the Council or Police Officer.
10) The log to be recorded in a hard back book and to contain the following information:
a) All crimes reported;
b) All ejections of customers;
c) Any incidents of disorder
d) Any faults in the CCTV system.
PUBLIC SAFETY
11) The Premises Licence Holder shall ensure that no customers are allowed to enter the premises with any alcohol or other open bottles, whether sealed or open, when the premises are open for licensable activity.
12) Any person(s) who appeared to be intoxicated shall not be served and shall be asked to leave the premises.
THE PREVENTION OF PUBLIC NUISANCE
13) Refuse will not be removed from the premises for disposal between the hours of 23.00 and 07.00am.
14) There will be placed immediately outside the entrance/exit to the premises one bin for customers to dispose of their waste.
15) At the end of every evening, a member of staff will ensure that any rubbish found immediately outside the premises will be collected and disposed of appropriately.
16) There shall be placed at the entrance/exit notices requiring customers to leave the premises quicky and quietly.
17) No external speakers will be allowed outside the premises.
18) Those customers wishing to purchase and consume their food inside the premises must be seated at a table while they consume their food.
19) Those customers who wish to purchase food for takeaway must be asked to leave the premises quickly and quietly once there order has been prepared.
THE PROTECTION OF CHILDREN FROM HARM
None.
