ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. THE PREVENTION OF CRIME & DISORDER
a) The CCTV system should be designed and installed in accordance with Cheshire Constabulary’s CCTV guidance document called “CCTV in Licensed Premises - an Operational Requirement”.
b) The Images recorded by the CCTV system shall be retained in an unedited format for a period of not less than 28 days.
c) CCTV equipment shall be maintained in good working order in accordance with the manufacturer’s instructions and shall be operational at all times when a licensable activity takes place on the premises.
d) Designated supervisors will need to demonstrate that their CCTV system complies with their Operational requirements. They will need to be able to demonstrate the following: -
· Recordings are fit for their intended purpose,
· Good quality images are presented to the officer in a format that can be replayed on a
· standard computer
· The supervisor has an understanding of the equipment/training,
· Management records are kept,
· Maintenance agreements and records are maintained,
· Data Protection principles and signage are in place.
e) Any person who is employed to have operational responsibility for the premises, must be trained in the use of any such CCTV equipment and
f) That person(s) must, upon reasonable request and as soon as practicable, make CCTV images available to a Police Officer or other Authorised Officer. When a request for CCTV is made by the Police, any footage should be uploaded using a secure link provided by the officer which will be sent to the appropriate person via an email or text message.
g) All staff members shall complete responsible alcohol service training.
h) The area surrounding the café shall be well lit during the evening hours.
i) Security Training
· All staff members shall receive basic security training focused on preventing crime and disorder. Training shall cover how to recognise suspicious behaviour, how to respond to incidents and how to report them to the authorities.
Customer monitoring
· Staff shall be trained to observe customer behaviour within the café and to promptly report any disorderly or criminal behaviour to the appropriate authorities.
· Staff shall be trained to communicate with customers in a safe and respectful manner.
j) Alcohol service limitations
· No customer shall be served excessive amounts of alcohol and those displaying signs of intoxication shall not be further served.
· Alcohol shall be carefully monitored during food services.
k) Emergency Plans
· Emergency plans shall be developed to address potential crime and disorder situations. All staff shall be familiar with these plans.
l) Collaboration with authorised persons
· Regular communication shall be maintained with local Police and other authorised persons.
m) Alcohol shall only be served by authorised staff and during the designated hours within the specific area for sale.
2. PUBLIC SAFETY
a) Emergency exits shall be kept clear and free of obstacles.
b) First aid kits shall be accessible throughout the café and staff shall be trained in basic first aid.
c) The interior layout of the café shall be designed to allow customers to move freely and evacuate easily.
d) Tables and chairs shall be arranged to avoid obstructing exit routes.
e) Wheelchair users and other individuals with disabilities, shall be able to navigate the cafe safely.
3. PREVENTION OF PUBLIC NUISANCE
a) Measures shall be taken to manage customer entry and exit in a way that prevents crowding around the café.
b) Staff shall be assigned to monitor the entrance and exit area ensuring that customers move quietly and to not gather in large groups.
c) Waste generated during the cafe operation shall be regularly collected and properly disposed of.
d) Bins shall be kept in enclosed areas.
e) Regular cleaning shall be carried out around the café to prevent litter accumulation.
f) Customers shall also be informed and encouraged to keep the area free of litter.
g) A complaint hotline shall be established for nearby residents and customers. Any complaints received shall be promptly addressed and resolved.
h) Regular communication shall be maintained with the local community to inform them of any potential disturbances and the measures being taken to mitigate them. Feedback shall be taken into account and necessary adjustments shall be made continuously.
j) Sound proofing measures shall be implemented to minimise noise disturbances.
4. THE PROTECTION OF CHILDREN FROM HARM
a) A “Challenge 25” policy shall be operated at the premises at all times. Publicity materials notifying customers of the operation of the “Challenge 25” Scheme shall be displayed at the premises.
b) The only forms of ID that shall be accepted (at the discretion of the Management) as proof of age are a valid passport, a valid photographic driving licence, a PASS approved proof of age card, HM Services Warrant Card or other reliable photo ID (that has been approved for acceptance by the Police or an Officer of the Local Authority)
c) The Designated Premises Supervisor or Premises Licence Holder shall operate and maintain an up-to-date Register of Refusals of Sale of Alcohol, indicating the date, time and reason for refusal which shall be made available for inspection by Local Authority Officers and the Police. The DPS or other responsible person shall check and sign the register once a week. Alternatively, an electronic point of sale refusals log shall be kept.
d) A documented training programme shall be introduced for all staff in a position to sell, serve or deliver alcohol. A written record for each member of staff shall be kept of the content of such training and shall be made available for inspection at the request of Local Authority Officers and Police.
e) The DPS or Premises Licence Holder shall conduct six monthly training reviews with all members of staff authorised to sell, serve or deliver alcohol in order to reinforce the training and to promote best practice. A written record for each member of staff shall be kept of the content of such reviews and shall be made available for inspection at the request of Local Authority Officers and Police.
f) A list of persons authorised to sell alcohol shall be kept on site and made available for inspection at the request of Local Authority Officers and Police.
g) Notices advising adults that it is an offence to purchase alcohol on behalf of under 18-year-olds shall be prominently displayed in the licensed area.
h) The designated area for sale of alcohol shall be organised to prevent easy access by children.
i) Alcohol sales shall be limited to times when children are less likely to be present in the café.
j) Alcohol shall be conducted by a holder of a personal licence.
k) Staff shall be trained on the importance of protecting children from harm, including recognising and handling situations where children may be at risk.
l) Children's access to certain areas of the premises, particularly those where alcohol is served shall be limited.
