ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
THE PREVENTION OF CRIME & DISORDER
1. The CCTV system should be designed and installed in accordance with Cheshire Constabulary’s CCTV guidance document called "CCTV in Licensed Premises - an Operational Requirement".
2. CCTV cameras will be positioned both internally and externally.
3. Plans indicating the positions of all CCTV cameras are to be submitted to the Force Licensing Officer for Cheshire Constabulary prior to the premises opening to members of the public for the first time following grant of this licence.
4. There shall be sufficient trained staff to download any images at the time if required by a Police Officer or authorised Council officer for the purposes of crime prevention and detection.
5. CCTV equipment shall be maintained in good working order in accordance with the manufacturer’s instructions and shall be operational at all times when a licensable activity takes place on the premises.
6. There are sufficient CD Roms, or other suitable materials to be available for the purposes of downloading such images.
7. The PLH (Premises Licence Holder) or DPS (Designated Premises Supervisor) shall need to demonstrate that the CCTV system complies with their operational requirements. A commissioning test must be carried out with the
licensing and CCTV liaison officers before hand over of the system. The Commissioning test shall need to demonstrate the following:-
a) Recording are fit for their intended purpose;
b) Good quality images are presented to the officer in a format that can be replayed on a standard computer;
c) The supervisor has an understanding of the equipment/training;
d) Management records are kept;
e) Maintenance agreements and records are maintained; and
f) Data protection principles and signage are in place.
8. The Premises Licence Holder shall ensure that all duty managers, the PLH themselves and the DPS are trained on the full usage, including the downloading of images, of the CCTV system.
9. CCTV images shall be made available to be viewed on the premises by a Police Officer or other authorised officer following a written request to the Premises Licence Holder, not later than 24 hours following the request.
Any request for a hard copy of any CCTV footage shall be made available by the Premises Licence Holder within two working days of the request.
10. The images recorded by the CCTV system shall be retained in an unedited format for a period of not less than 28 days.
11. The PLH shall put in place a written search, drugs & weapons policy for the premises. The Policy is to be "signed" off by a member of Cheshire Constabulary and the Premises Licence Holder to confirm all parties agree to its
contents. The PLH shall then ensure that this policy is complied with at all times the premises are open to members of the public. Notices advising customers of the policy shall be displayed at all entrances to the premises.
12. The PLH or DPS shall be responsible for ensuring there is a written policy to assist in the safe & quiet dispersal of customers at the end of permitted licensing hours. The policy must be available for inspection to the Police or
Local Authority Officers upon request.
13. The Premises Licence Holder shall be an active member of the Town Centre Radio Link scheme. At all times the premises are open to members of the public, one registered Door Supervisor must have the radio on their person
and the radio must be switched on.
14. There shall be provided at the premises, every Thursday, Friday & Saturday evenings from 9pm to the close of the premises, SIA registered Door Supervisors, to such a number, as the management of the premises consider
sufficient to control entry to the premises and keeping order in the premises when they are open for licensable activity.
15. Door supervisors must be employed through an SIA approved Security Company/Provider.
a. Where any person is employed on or about the Premises as a Door Supervisor the Premises Licence Holder shall maintain a register in hard copy format showing in respect of each period of duty of that person:-
i.The name, date of birth, badge or licence number and residential address of that person;
ii.The time at which they commenced the period of duty, with a signed acknowledgement by that person;
iii.The time at which they finished the period of duty, with a signed acknowledgement by that person;
iv.Any time during the period of duty when they were not on duty; and
v. If that person is not an employee of the Premises Licence Holder, the name of the person by whom that person is employed, or through whom the services of that person were engaged.
b. The register if in hard copy shall be of hardback construction with consecutive numbered pages.
c. The register shall be kept on the premises at all times and shall be available for inspection upon request by an authorised officer of the Licensing Authority or a Police Officer.
d. Door Supervisors shall be required to wear a reflective waistcoat that shall;-
i. Be a specified colour;
ii.Have the approved wording "SECURITY" on the front and rear; and
iii.Have a clear plastic pocket to display the SIA badge securely in a prominent position.
e. Door Supervisors employed at the premises may only be provided by a company which is currently validated by the Security Industry Authority (SIA) "Approved Contractor Scheme".
16. The Premises Licence Holder and DPS shall keep a log of all incidents that occur on the premises when it is open to members of the public. All instances of crime and/or disorder shall be reported to a member of Cheshire Constabulary as soon as is practicable.
17. Any person who appears to be intoxicated shall not be served and shall be asked to leave. Persistent offenders shall be barred from the premises.
18. A log book of anyone refused to be served will be kept with the name, date and time of the refusal.
19. A Personal Licence Holder shall be present on the premises at all times the premises is open to members of the public.
20. The Premises Licence Holder or DPS shall ensure that no customers carrying open bottles upon entry shall be admitted to the premises at any times when the premises are open to members of the public.
21. The Premises Licence Holder or DPS shall ensure that no customers are allowed to remove from the premises any alcohol unless it is re-corked or sealed before it is removed. This condition does not relate to customers consuming alcohol on the 3rd floor terrace area.
22. There shall be no entry or re-entry to the premises after 02.30am Thursday-Saturday (save for returning smokers).
23. The first floor will be used primarily as a restaurant where food must be available when the premises are open for licensable activity. Alcohol shall only be supplied in conjunction with and ancillary to a seated table meal and
must be supplied by means of a waiter/waitress service only.
24. The second floor shall be used as a restaurant/terrace bar where food must be available when the premises are open for licensable activity. Food and/or alcohol will be served by a waiter/waitress. Food consumption when the
premises are open for licensable activity will be at a seated table.
PUBLIC SAFETY
1. The PLH or DPS will ensure that a First Aid box is available on the premises at all times it is open to members of the public.
PREVENTION OF PUBLIC NUISANCE
1. Noise from amplified music or voices shall not be such as to cause a noise nuisance to occupants of nearby premises.
2. No noise shall emanate from the premises nor vibration to be transmitted through the structure of the premises which gives rise to a nuisance.
3. No external speakers shall be permitted except on the 3rd floor terrace area.
4. All doors and windows must be kept closed (except to allow ingress and exit) when any amplified music or voices, including live or recorded music are being played within the premises.
5. Notices shall be displayed on the 2nd floor terrace area requesting the public to respect the needs of local residents by keeping noise to a minimum when using the outside area of the premises. All such signs must be in a permanent form, prominently placed and legible.
6. Prominent, clear and legible signs must be displayed at all exits and in key areas, requesting the public to respect the needs of the local residents and to leave the premises quickly and quietly.
7. The emptying of bins into skips, the removal of refuse from the building, and refuse collections will not take place between 11pm and 7am each day.
8. The designated premises supervisor or their representative shall conduct regular assessments of the noise emanating from the premises, including the 3rd floor terraced area and shall take steps to reduce the level of noise where it is likely to cause disturbance to local residents. A written record of those assessments and the remedial action taken shall be kept and shall include the date, time of checks and the name of the person carrying out the checks. Records shall be made available to Officers of Warrington Borough Council or Cheshire Constabulary immediately upon request.
THE PROTECTION OF CHILDREN FROM HARM
1. A "Challenge 25" policy shall be operated at the premises at all times. The only forms of ID that shall be accepted (at the discretion of the management) as proof of age are a valid passport, photographic driving licence, a PASS
approved proof of age card or H.M. Services Warrant Card or other reliable photo ID (that has been approved for acceptance by the Police or other responsible authority).
2. Publicity materials notifying customers of the operation of the "Challenge 25" scheme shall be displayed at the premises.
3. The Designated Premises Supervisor or Premises Licence Holder shall operate and maintain an up-to-date Register of Refusals of Sale of Alcohol, indicating the date, time and reason for refusal which shall be made available
for inspection by Local Authority Officers and the Police or other relevant authority. Alternatively, an electronic point of sale refusal log shall be kept.
4. A documented training programme shall be introduced for all staff in a position to sell, serve or deliver alcohol. The programme shall be made available for inspection at the request of Local Authority Officers and the Police.
5. The DPS or PLH shall conduct 6 monthly training reviews with all members of staff authorised to sell, serve or deliver alcohol in order to reinforce the training and to promote best practice. A written record shall be kept of the
content of such reviews for each individual member of staff.
6. A written or printed list of persons authorised to sell alcohol shall be kept on site and made available for inspection at the request of Local Authority Officers and Police.
7. Notices advising adults that is an offence to purchase alcohol for persons under 18 years old shall be displayed. (Exception are those alcoholic drinks that can be legally purchased and consumed with a meal).
Under 18’s Under 18’s events will not take place without prior consultation with Cheshire Constabulary and Local Authority Officers. The consultation shall take place not less than 10 days before any planned event.
