ANNEXE 1 - MANDATORY CONDITIONS
Supply of Alcohol
No supply of alcohol may be made under the premises licence:
() at a time when there is no designated premises supervisor in respect of the premises licence, or
() at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Age Verification
(1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -
(a) a holographic mark, or
(b) an ultraviolet feature.
Permitted Price
1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
2. For the purposes of the condition set out in paragraph 1:-
(a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;
(b) “permitted price” is the price found by applying the formula -
P = D + (D x V)
where -
(i) P is the permitted price
(ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-
(i) the holder of the premises licence
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.
3. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
4. (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
GENERAL
1) The Premises Licence Holder (PLH) shall have ultimate discretion on the question of accepting any and all bookings for the use of this area. The PLH shall consult with any other Council departments or other Responsible Authorities as they deem appropriate, before accepting any booking. The PLH's decision in this matter is final.
2) A schedule of forthcoming events shall be submitted to Warrington Borough Council (Enviromnental Protection) (Environment Services) and Cheshire Police for assessment every three months.
THE PREVENTION OF CRIME AND DISORDER
1) Each event shall be risk assessed and audience demographic determined, security staff provided by Showsec should the need be identified within the risk assessment. We will ensure that any Door Supervisors used are registered by the Security Industry Authority.
2) Strong management controls and ensure effective training of all staff so that they are aware of the premises license and the requirements to meet the four licensing objectives.
3) Staff will be vigilant in preventing the use of illegal drugs within events and report through the correct channels.
4) Bag checks will take place on entry to the event site should the need be identified in the individual event risk assessment.
5) Drinks will be served in plastic containers.
6) At events where alcohol is served, all bar staff will adhere to the Challenge 25 policy and will also ensure that the sale of alcohol does not take place to drunk or intoxicated customers.
7) Police will be notified prior to the event via the local Events Safety Advisory Group.
8) A log of all incidents and any ejections from the site will be kept.
PUBLIC SAFETY
1) An event safety plan will be completed for all events taking place within the site including individual event risk assessments and evacuation procedures.
2) All events will be managed using relevant industry guidance including The Purple Guide to Health, Safety and Welfare at Music and Other Events, CDM regulations 2015, Managing crowds safely HSG 154 and others Health and safety documentation including risk assessments must be provided from all contractors working within the event. This also includes full public liability insurance certificates in advance.
3) A pre-event walk through of the site will take place before each event to ensure public safety.
4) Barriers will be used to secure any potential hazards or restricted areas duration of the event itself, build and load out phases. Dependant on the hazard this will be either Heras, pedestrian or mojo front of stage barrier.
5) The site will be managed by a designated event manager for the duration of the event.
6) If first aid provision is identified as being required this will be provided by trained personnel. We will follow the guidelines and calculation within the purple guide regarding the number of first aiders and level of cover.
7) The site has a reasonable level of site lighting to allow access / exit to the site should events take place in twilight hours.
8) If power is required on events this will be provided by diesel generators. Power will be provided and connected by a trained and competent person. We will ensure generators are not accessible to the public and all cables will be secured with cable ramps.
9) Within the individual event risk assessments, if overcrowding is identified as a foreseeable risk, access will then be controlled and attendees counted to prevent overcrowding.
10) Consideration for exiting the site in an emergency will be given and the required number of exits will be in accordance with Health and Safety guidelines.
11) The PLH shall submit an appropriate Event Management Plan to all Responsible Authorities not less than 35 days prior to the date of an event.
THE PREVENTION OF PUBLIC NUISANCE
1) Adequate toilets facilities are available within the surrounding establishments. For larger events Pyramid arts centre or Parr Hall is opened specifically for toilet provision.
2) A noise management plan shall be submitted for any event which includes live or recorded music to Warrington Borough Council (Environmental Protection) a minimum of 35 days before the event takes place.
3) Sound levels will be monitored and recorded throughout events from different areas of the site. This includes from the parameter of local residential properties.
4) Any PA systems will be positioned in such a way so as to minimize disturbance to local residents.
5) Any person(s) deemed inebriated will be instructed to leave the site by security staff/ event management.
6) Refuse bins will be provided for events and litter pickers will operate on site.
7) Deliveries of equipment and set up for the event will be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents.
THE PROTECTION OF CHILDREN FROM HARM
1) Challenge 25 policy will be employed where those individuals who appear to be under the age of 25 attempting to purchase alcohol will be asked for the appropriate identification.
2) All staff responsible for selling age restricted goods will be trained appropriately; staff training records will be maintained and audited. Any refusals will be documented.
3) For larger events a lost persons point will be located within the event area which will be clearly marked and sign posted. Protocols for recording lost persons will be in place which includes what information should be relayed over the radio or pa system.
4) Restricted access to hazardous areas to ensure safety for adults and children.
5) Due to the nature of events taking place, noise levels will not be excessive and will be monitored in line with the noise management plan.
6) Culture Wanington staff/ event staff will be easily identifiable, have received safeguarding training know what they should do if they have concerns about the safety of children.
7) Contracting of Showsec security when required with full DBS checks.
8) The only forms of ID that shall be accepted (at the discretion of the Management) as proof of age are a valid passport, a valid photographic driving licence, a PASS approved proof of age card, HM Services Warrant Card or other reliable photo ID (that has been approved for acceptance by the Police or an Officer of the Local Authority)
9) Publicity materials notifying customers of the operation of the 'Challenge 25' scheme shall be displayed at the premises.
10) The DPS or Premises Licence Holder shall conduct six monthly training procedure reviews with all independent operators on site who are in a position to sell alcohol in accordance with the Premise Licence (in order to reinforce the training and to promote best practice). A written record for each vendor shall be kept of the content of such reviews and shall be made available for inspection at the request of Local Authority Officers and Police.
11) A list of persons authorised to sell alcohol shall be kept on site and made available for inspection at the request of Local Authority Officers and Police.
