ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. THE PREVENTION OF CRIME & DISORDER
a) Customers shall be confined to the front of the shop where control can be monitored by trained staff and adequate signage.
b) Internally, CCTV cameras are present with adequate signage and trained staff monitoring rowdy or abusive customers.
c) The CCTV system should be designed and installed in accordance with Cheshire Constabulary’s CCTV guidance document called “CCTV in Licensed Premises - an Operational Requirement”.
d) The Images recorded by the CCTV system shall be retained in an unedited format for a period of not less than 28 days and up to 6 months.
e) An incident logbook shall be kept at the premises to log any problems or disorder.
f) CCTV equipment shall be maintained in good working order in accordance with the manufacturer’s instructions and shall be operational at all times when a licensable activity takes place on the premises.
g) Designated supervisors will need to demonstrate that their CCTV system complies with their Operational requirements. They will need to be able to demonstrate the following: -
• Recordings are fit for their intended purpose,
• Good quality images are presented to the officer in a format that can be replayed on a standard computer
• The supervisor has an understanding of the equipment/training,
• Management records are kept,
• Maintenance agreements and records are maintained,
• Data Protection principles and signage are in place.
• They system has the correct date/time stamp at all times.
h) Any person who is employed to have operational responsibility for the premises, must be trained in the use of any such CCTV equipment.
i) That person(s) must, upon reasonable request and as soon as practicable, make CCTV images available to a Police Officer or other Authorised Officer.
j) When a request for CCTV is made by the Police, any footage should be uploaded using a secure link provided by the officer which will be sent to the appropriate person via an email or text message.
k) A CCTV monitor shall be positioned in an area showing real time footage from all cameras to allow members of staff to monitor any activities. This monitor must be fully functional at all times the premises is open to the public.
l) Only staff members, officers from Responsible authorities and persons carrying out maintenance/safety checks are permitted to be behind the counter, in the food preparation and storage areas.
m) No customers to be allowed behind the counter at any time.
n) A written record shall be kept on the premises by the PLH of every person employed on the premises in a register for that purpose. That record shall contain the following details:-
· time/date he/she starts and finishes each duty,
· name, address and date of birth of each member of staff - including delivery drivers,
· a record of vehicle registration numbers used in any delivery service and
· a copy of vehicle insurance.
o) The premises licence holder when employing staff members will carry out checks on the person to ensure that they have the right to live and work in the UK, any Concerns regarding a potential employee are to be brought to the attention of the appropriate authorities.
p) All checks made along with the outcome will be documented in an appropriate book or spreadsheet. Staff will only be employed if they have the correct entitlement to live/work in the UK.
q) The documented checks will be made available for inspection at the request of Local Authority Officers, Police and Immigration.
r) 15 minutes before the premises are due to close there shall be no new customers permitted to enter the premises, this is to allow any orders already taken to be completed before the terminal hour.
s) The premises shall close at 01:00 on Sunday to Thursday and 02:00 on Friday and Saturday.
t) Notices shall be prominently displayed at all exits requesting patrons to respect the needs of the residents and leave the area quickly and quietly.
u) The applicant has not made any reference to the business offering a delivery service although customers can order from them through Just Eat and Uber Eats along with their own website. Therefore, the following conditions apply to the delivery service:
v) The premises licence holder or designated premises supervisor shall ensure that orders are dispatched to bona fide addresses only.
w) Drivers will not deliver to any person anywhere other than at the residential address given when the order was placed.
x) Customers must be instructed when placing the order that they will not be able to collect the order from the vehicle. All deliveries will only be made directly to the property address and customers will not be permitted to take orders from the vehicle.
y) Where delivery drivers are employed directly by the premises licence holder, a register of drivers’ details must be kept on the premises along with details of the vehicles used and checks made that valid insurance is held. The register must be made available for inspection by Local Authority officers and the Police.
z) The premises licence holder must instruct delivery riders and drivers not to cause a noise nuisance when making deliveries or whilst waiting outside the premises for collections.
2. PUBLIC SAFETY
a) Public safety shall be preserved by ensuring non-staff do not encroach or trespass beyond the serving hatch.
b) Signage to be clearly displayed warning of potential dangers with adequate lighting.
c) The waiting area shall be well lit to prevent trips and hazards.
d) Adequate signage is present to deter any accidents and the shop staff to ensure that the servery hatch is locked at all times.
3. PREVENTION OF PUBLIC NUISANCE
a) Staff to ensure that rowdy crowds do not congregate in the shop.
4. THE PROTECTION OF CHILDREN FROM HARM
a) Children to be under supervision with parents or guardians after 8pm.
