ANNEXE 1 - MANDATORY CONDITIONS
MANDATORY CONDITIONS UNDER THE LICENSING ACT 2003
Supply of Alcohol
No supply of alcohol may be made under the premises licence:
() at a time when there is no designated premises supervisor in respect of the premises licence, or
() at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Drinks Promotions
(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
Water
The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
Age Verification
(1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -
(a) a holographic mark, or
(b) an ultraviolet feature.
Measures
The responsible person must ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.
Permitted Price
1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
2. For the purposes of the condition set out in paragraph 1:-
(a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;
(b) “permitted price” is the price found by applying the formula -
P = D + (D x V)
where -
(i) P is the permitted price
(ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-
(i) the holder of the premises licence
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.
3. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
4. (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The Prevention of Crime and Disorder
1) The security team/company shall be fully SIA licensed and trained.
2) Notices warning of potential criminal activity, such as theft, that may target customers shall be
displayed.
3) Staff shall be well trained in asking customers to use premises in an orderly and respectful manner and prevent drinking
alcohol outside of permitted areas.
4) The public shall not be permitted to bring their own alcohol to the event.
5) Campers shall not be permitted to bring their own alcohol to the event.
6) Plastic cups shall be marked in accordance with the Weights and Measures legislation.
7) A logbook shall be kept at each bar registering drunken behaviour and incidents.
8) Tickets shall be exchanged for wristbands on the gate.
9) Ticket holders will be able to leave and re enter the site up till 6pm, after this time no re entry will be allowed.
10) All vehicles must be on site by 12:00 noon. No movement of vehicles shall be permitted after this time unless in the case of an emergency. In which case the vehicle will be escorted from the carpark by an official.
11) Any none campers must vacate the site immediately after the music is turned off.
12) Security shall be in control of clearing the arena and sweeping the site to ensure all none campers have vacated the site.
13) In the event of an emergency evacuation there shall be a clear path for emergency vehicles from the entrance through the campsite and to the main arena.
Public Safety
1) Internal and external lighting shall be in place.
2) A log book or recording system shall be kept on site in which shall be entered particulars of inspections made;
those required to be made by statute, and information compiled to comply with any public safety condition attached to the
premises license that requires the recording of such information. The log book shall be kept available for inspection when
required by persons authorised by the authorities.
3) All parts of the premises and all fittings and equipment will be maintained at all times and be kept in good order and condition.
4) No fires shall be permitted on the campsite.
The Prevention of Public Nuisance
1) The Premises License Holder shall appoint a suitably qualified and experienced Acoustic Consultant who shall be required to advise the Premises License Holder. The Consultant shall manage noise generated during the licensed events and liaise with all the relevant parties ie the Premises License Holder, the Environmental Protection Team at Warrington Borough Council, Event Promoters, Sound System and Performers, prior to and during the licensed event.
2) At least three calendar months in advance of the event taking place, submit to the Environmental Protection Department a "Noise Management Plan" for prior written approval in advance of the event taking place. Thereafter, the approved "Noise Management Plan" shall be observed and complied with in full. Subject to Environmental Protection being satisfied, written approval will be given no later than two months in advance of the event taking place with any modifications only being made with the prior consent of Environmental Protection. For the avoidance of doubt the "Noise Management Plan" shall include the following elements:
Shall clearly define the arrangements to secure compliance with the "Music Noise Level" throughout the event and the organisational management to secure the same. Where the "Music Noise Level" is breached, details of corrective action shall be appropriately documented.
The "Music Noise Level" shall not exceed 65dB LAeq (15 mins) 1 metre from the facade of any noise sensitive premises in the areas surrounding Tetley Walker Sports and Social Club (measured or where this is not achievable calculated from a nearby representative measurement position).
This will be achieved using decibel meters during sound testing prior to the main event.
Shall clearly define the arrangements for receiving and responding to complaints from the community about noise and other issues associated with the build-up and clearance of the site infrastructure and the event itself.
All complaints shall be documented with the date and time of receipt, contact details for the complainant, details of the person receiving the complaint, details of the complaint, details of the investigation made and the date and time of any feedback given to the complainant.
Not later than 7 days in advance of the event taking place each household and business within the vicinity of the site (to be agreed with the Local Authority) shall be provided with details of how to make a complaint about event related noise, and be provided with an event timetable including times and dates for the erection and dismantling of the site infrastructure, sound propagation and speaker tests, sound checks time of the first chord and last chord for each day.
3) Within one calendar month of the event taking place, a full "Noise Report" prepared by a technically competent representative of the Acoustic Consultant shall be submitted to the Environmental Protection Department in writing.
This report shall include:
i. Details of the findings of the noise monitoring undertaken during the event.
ii. Details of the number of occasions and duration when the "Music Noise Level" was exceeded.
iii. Details of the corrective action taken to ensure compliance with the "Music Noise Level".
iv. Provide a full breakdown of noise complaints received and the action taken.
v. Make recommendations for improvements in the management of event related noise for subsequent events.
4) Studio 3 have been tasked with noise management. A noise management plan will be attached to the site management plan.
5) Prominent, clear and legible notices will be displayed at the exit requesting the public to respect the needs of nearby
residents and to leave the premises and the area quietly.
6) The public will be asked not to stand around loudly talking in the street outside the premises.
7) Any lighting on or outside the premises will be positioned and screened in such a way so as to not cause a disturbance to
nearby residents.
8) All speakers and music will be directed away from residential areas.
9) All amp equipment will be limited using specialist limiting devices which will be set to the appropriate achieved during testing.
10) Strict no music or noise policy outside of licensed times on site and on the camp site.
11) Use of silent generators shall be in place.
12) All none essential generators to be switched off when not in use or after hours.
13) Adequate waste receptacles for use by customers shall be provided in the local vicinity.
14) Staff shall patrol the campsite after hours to deter noise.
15) No music policy shall be in place on the campsite.
16) A dedicated phone and log book will be kept at security for receiving and responding to complaints from the community about noise and other issues. The relevant local authorities will have access to the phone number which will be manned 10 days before, during and 10 days after the event.
The Protection of Children from Harm
1) Each outlet from which alcohol is to be sold or served shall operate a 'Challenge 25' policy at all times when the sale of alcohol is permitted.
The only forms of ID that shall be accepted (at the discretion of the Event Licence Holder) as proof of age are a valid passport, a valid photographic driving licence, a PASS approved proof of age card or HM Services Warrant Card.
Publicity materials notifying customers of the operation of the 'Challenge 25' scheme shall be displayed on site and at each outlet from which alcohol is to be sold.
2) Publicity materials notifying customers that it is an offence for adults to purchase alcohol on behalf of people under 18 years old shall be displayed on site and at each outlet from which alcohol is to be sold.
(The above condition No2. is included should any under 18s manage to slip through the net)
3) At each point of sale for alcohol a documented training programme shall be in place for all staff in a position to sell, serve or deliver alcohol. A written record for each member of staff shall be kept of the content of such training and shall be made available for inspection at the request of Local Authority Officers and Police.
4) Each point of sale for alcohol shall have (and maintain) an up-to-date Register of Refusals of Sale of Alcohol, indicating the date, time and reason for refusal which shall be made available for inspection by Local Authority Officers and the Police. The Event Licence Holder or other responsible person shall check and sign the register during the course of the event. Alternatively an electronic point of sale refusals log shall be kept.
