ANNEXE 1 - MANDATORY CONDITIONS
Supply of Alcohol
No supply of alcohol may be made under the premises licence:
() at a time when there is no designated premises supervisor in respect of the premises licence, or
() at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Age Verification
(1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -
(a) a holographic mark, or
(b) an ultraviolet feature.
Permitted Price
1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
2. For the purposes of the condition set out in paragraph 1:-
(a) 'duty' is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;
(b) 'permitted price' is the price found by applying the formula -
P = D + (D x V)
where -
(i) P is the permitted price
(ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) 'relevant person' means, in relation to premises in respect of which there is in force a premises licence-
(i) the holder of the premises licence
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) 'relevant person' means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) 'value added tax' means value added tax charged in accordance with the Value Added Tax Act 1994.
3. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
4. (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day ('the first day') would be different from the permitted price on the next day ('the second day') as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
THE PREVENTION OF CRIME & DISORDER
1) When CCTV is installed in the premises it shall comply with the Cheshire Constabulary Operational Guidelines for CCTV.
2) CCTV equipment shall be maintained in good working order in accordance with the manufacturer's instructions and shall be operational at all times when a licensable activity takes place on the premises.
3) A written record shall be kept of images that are recorded by CCTV and shall include details of the recording medium used, the time and date recording commenced and finished. The record shall identify the person responsible for the recording and shall be signed by him/her. Where the recording is on a removable medium(i.e videotape,compact disc,flash cards etc), a secure storage system to secure those recording mediums shall be provided.
4) The images recorded by the CCTV system shall be retained in unedited form for periods of not less than 31days
5) CCTV images shall be made available to the Police or an authorised officer on request for crime prevention/detection purposes. The Premise Licence holder or Designated Premise Supervisor (DPS) shall ensure that there are sufficeient staff trained on the premises who can download CCTV images at the time of a request to maximise the effectiveness of any Police enquiry to detect and prosecute offenders.
PUBLIC SAFETY
None.
PREVENTION OF PUBLIC NUISANCE
6) All sales of alcohol must be paid for at the time of ordering. Payment shall be made by debit or credit card, or electronic payment such as Apple Pay, Android Pay, etc.
7) There shall be no deliveries or collections of alcohol to or from the premises between 22:00 and 06:00 on the following day.
8) The staff at the premises shall ensure delivery drivers enter and leave the premises in a quiet and respectful manner. Delivery drivers will be encouraged to not play loud music or rev cars if waiting for deliveries.
9) From 06:00 until 07:00 each day, all deliveries will be restricted to store to customer delivery services such as Uber Eats only.
THE PROTECTION OF CHILDREN FROM HARM
10) A 'Challenge 25' policy shall be operated at the premises at all times. All staff shall check identification of all persons who appear to be less than 25 years old. This check shall be made by examining either a valid passport, photographic driving licence or a PASS approved proof of age card. No other form of identification shall be accepted without the approval of Trading Standards, Local Authority Licensing Officers and Police.
11) There will be an age verification requirement by staff regarding all sales of alcohol made over the telephone and via online sales with a declaration made by those purchasing that they are over the legal age for purchasing alcohol.
12) There shall be prominent signage located throughout the store confirming the legal minimum age for the purchase of alcohol.
13) Publicity materials notifying customers of the operation of the 'Challenge 25' scheme shall be displayed at the premises.
14) The Premises Licence holder shall operate and maintain an up-to-date Register of Refusals of Sale of Alcohol (electronic or written), indicating the date, time and reason for refusal which shall be made available for inspection by Trading Standards, Local Authority Licensing Officers and Police.
15) A documented training scheme shall be introduced for all staff. The contents of that scheme shall be made available for inspection at the request of Trading Standards, Local Authority Licensing Officers and Police. The Premises Licence holder/Designated Premises Supervisor shall maintain a record at the premises for each person authorised to sell alcohol. The file shall contain all training records for that person.
16) The Premises Licence holder/Designated Premises Supervisor shall conduct quarterly reviews with each person authorised to sell alcohol in order to reinforce the training and to promote best practice. A written record shall be made of the content of such reviews.
17) The premises shall operate in accordance with the Challenge 25 scheme. The scheme operates on the basis that, whilst alcohol may be sold to persons aged 18 years and over, at the point of delivery any person who appears under 25 years of
age will be asked for a valid form of identification. This challenge will be made by the person making the delivery.
a) The only acceptable forms of valid ID are a:
i. proof of age card bearing the PASS hologram logo;
ii. passport; or
iii. UK photo driving licence
iv. Military ID
18) Alcohol will not be delivered to any person who is challenged and fails to provide an acceptable form of ID.
19) A written or digital record of refusals (to leave alcohol at given address) shall kept and maintained by the delivery provider and its riders, recording the address, date, time and reason for the refusal.
20) Alcohol may not be sold from the delivery vehicle.
21) The delivery partner and its riders will not allow minors (anyone under the age of 18) to sign for or accept deliveries which contain alcohol. The Premises Licence Holder shall, at the request of an authorised Officer of the Local Authority or Police, produce full details of the couriers used and the system they use to verify age.
