ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Prevention of Crime & Disorder
1 The Premises shall operate a midnight last entry policy. Members of the public shall not be permitted to enter the premises after midnight unless they are existing customers who entered the premises initially prior to midnight and are seeking entry from external areas such as external drinking or smoking areas.
2 On evenings when the premises intend to provide regulated entertainment or retail alcohol after midnight a minimum of 2 SIA registered door supervisors will be employed from 21.00hrs onwards. The management will make reasonable efforts to employ at least 1 female door supervisor at these times.
3 All number of door supervisors required will be determined by the Premise Licence Holder by reference to a risk assessment prepared by on behalf of the Premises Licence Holder. A copy of the assessment will be available for inspection by any Police Officer or authorised officer of the Licensing Authority upon reasonable notice.
4 All door supervisors employed at the premises shall wear yellow or orange conspicuous jackets to a standard similar or better than those currently supplied by the local Crime and Disorder Partnership.
5 Any person exercising a security activity (as defined by paragraph 2(1)(a) of schedule 2 of the Private Seecurity Industry Act 2001) shall be licensed by The Security Industry Authority.
6 Any such person referred to in condition (5) shall be linked by means of text or radio pager to the police enabling the police to be alerted to instances of crime and/or disorder (when required)
7 Any person as defined in condition (5) will clearly display his name badge at all times whilst on duty.
8 There shall be installed within the premises sufficient numbers of bottle bins of a type with ‘non-returnable’ aperture, as to prevent empty bottles being deposited around the interior of the venue, such bins shall be emptied as required. Staff employed at the premises shall be directed to clear any unattended bottles from public areas.
9 No drink shall be sold from a bar or by staff service or consumed in or on the premises other than in a container made from non-splintering plastic, paper or shatterproof glass.
10 No drink shall be removed from the premises in an unsealed container other than for consumption in an area so designated for this purpose.
11 No customers carrying open bottles upon entry shall be admitted to the premises at any times the premises are open to the public.
12 The management of the premises shall prepare a risk assessment to identify a safe capacity at the premises. A copy of the assessment shall be available for inspection by any Police Officer or authorised officer of the Licensing Authority upon reasonable notice.
13 On Friday and Saturday evenings, when the premises are employing door supervisors to maintain the numbers of customers admitted within the safe capacity as identified by the appropriate risk assessment. The door supervisors shall monitor the occupancy of the premises by means of ’clickers’.
14 The management shall collect occupancy information at other select peak times as determined by the management, including, but not limited to New Years Eve and Bank Holidays.
15 Where CCTV is installed with recording facilities such recordings shall be retained for a period of 30 days and made available within reasonable time upon request by the police.
16 The premises licence holder or their representative shall be an active member of the local pubwatch scheme.
The Prevention of Public Nuisance
Noise
1 All doors and windows must be kept closed (except to allow ingress and exit) when any amplified or unamplified music or voices are being played within the premises.
2 The licence holder or their representative shall conduct regular assessments of the noise coming from the premises, by means of a subjective assessment from outside the premises, and shall take steps to reduce the level of noise where it is likely to cause disturbance to local residents. A written record of those assessments and the remedial action taken shall be kept and will include the date, time of the checks and the name of the person carrying out the checks. Details of the remedial action will also be recorded.
3 There shall be placed at all exits of the premises in a place where they can be seen and easily read by the public notices requiring customers to leave the premises quickly and quietly.
4. No external speakers shall be used outside the building.
5. Noise or vibration shall not emanate from the premises so as to cause a nuisance to nearby
properties.
6. The use of any outside area will cease at 23.00
7. Refuse, including bottles, shall not be removed from the building for disposal between the
hours of 23.00 and 07.00.
Protection of children from harm
Children
Children under the age of 16 shall not be permitted to enter the premises after 19.00.
Proof of Age Schemes - Challenge 21
There shall be in place for the premises a written policy that employees challenge all persons purchasing alcohol who appear to be under 21 years of age. That policy shall require any person who appears to be under the age of 21 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence, passport or accredited student card.
Persons who appear to be under the age of 21 years shall be required to produce proof of age by way of a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence, passport or accredited student card.
