• ANNEX 1 - MANDATORY CONDITIONS

   

   

  A)   CONDITIONS REPRODUCING THE EFFECT OF RESTRICTIONS IMPOSED ON THE USE OF THE PREMISES FOR THE EXISTING LICENSABLE ACTIVITIES (PARAGRAPH 6(8) OF SCHEDULE 8 TO THE LICENSING ACT 2003).

   

  Permitted Hours

  Alcohol shall not be sold or supplied except during permitted hours.

  In this condition, permitted hours mean:

  ()                   On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 10.00 to 00.00

  ()                   On Sundays, other than Christmas Day or New Year’s Eve, 12.00 to 23.30

  ()                   On Good Friday, 12.00 to 23.30

  ()                   On Christmas Day, 12.00 to 23.30

  ()                   On New Year’s Eve, except on a Sunday, 10.00 to 00.00

  ()                   On New Year’s Eve on a Sunday, 12.00 to 23.30

  ()                   On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, 00.00 on 31 December).

   

  The above restrictions do not prohibit:

   

  ()                   during the first thirty minutes after the above hours the consumption of the alcohol on the premises;

  ()                   during the first thirty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken away in an open vessel;

  ()                   during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to their meals;

  ()                   Consumption of the alcohol on the premises, sale or supply of alcohol to(or the taking of) any person residing on the premises.

   

  Suitable non alcoholic beverages including drinking water, shall be equally available for consumption with or otherwise as an ancillary to meals served in the premises

   

  The premises must be bone fide used for the purpose of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises.

   

  Alcohol shall not be sold or supplied on the premises otherwise than to persons taking table meals there and for consumption by such a person as an ancillary to his meal.

   

  B)     CONDITIONS REPRODUCING THE EFFECT OF CONDITIONS SUBJECT TO WHICH THE RELEVANT EXISTING LICENCES HAD EFFECT (PARAGRAPH 6(6) OF SCHEDULE 8 TO THE LICENSING ACT 2003)

   

  1.        Intoxicants shall only be sold by waiter/waitress service to patrons seated at tables.

   

  2.       Substantial meals and non-intoxicating beverages shall be available at all times.

   

  C)      MANDATORY CONDITIONS

   

  1.              That no supply of alcohol may be made under the premises licence:-

   

  ()                   at a time when there is no designated premises supervisor in respect of the premises  licence, or

  ()                   at a time when the designated premise supervisor does not hold a personal licence or his personal licence is suspended.

   

  2.         That every supply of alcohol under the premises licence must be made or

        authorised by a person who holds a personal licence

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Prevention of public nuisance

   

  No nuisance shall be caused by noise or vibration coming from or transmitted through the structure of the buildings. This includes any external plant or equipment attached to the premises or within the curtilage of the premises.

   

  No external speakers shall be used outside the building, this will include any beer gardens or outside drinking area or car park.

   

  The use of any outside drinking/seating area will cease at 23.00 Monday to Saturday and at 22.30 Sunday.

   

  All doors and windows must be kept closed when any amplified or unamplified music or voices are being played within the premises.

   

  The Premises Licence Holder or their representative shall conduct regular assessments of the noise coming from the premises and shall take steps to reduce the level of noise where it is likely to cause disturbance to local residents.  A written record of those assessments and the remedial action taken shall be kept and will include the date, time of the checks and the name of the person carrying out the checks.  Details of the remedial action will also be recorded.

   

  There shall be placed at all exits of the premises in a place where they can be seen and easily read by the public [or members and their guests] requiring customers to leave the premises quickly and quietly.  This condition also extends to car parks where car radios and members of the public may cause disturbance to local residents.

   

  Refuse bottles shall not be removed from the building for disposal between the hours of 23.00 and 07.00.
