ANNEX 1 - MANDATORY CONDITIONS
A) CONDITIONS REPRODUCING THE EFFECT OF RESTRICTIONS IMPOSED ON THE USE OF THE PREMISES FOR THE EXISTING LICENSABLE ACTIVITIES (PARAGRAPH 6(8) OF SCHEDULE 8 TO THE LICENSING ACT 2003).
1 Permitted Hours
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours mean:
() On weekdays, other than Christmas Day, Good Friday or New Year’s Eve, 10.00 to 23.00
() On Sundays, other than Christmas Day or New Year’s Eve, 12.00 to 22.30
() On Good Friday, 12.00 to 22.30
() On Christmas Day, 12.00 to 15.00 and 19.00 to 22.30
() On New Year’s Eve, except on a Sunday, 10.00 to 23.00
() On New Year’s Eve on a Sunday, 12.00 to 22.30
() On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, 00.00 on 31 December).
Alcohol may be sold or supplied (for one hour following the hours set out above and) (on Christmas Day, between 15.00 and 19.00) to persons taking table meals in the premises in a part of the premises usually set apart for the service of such persons and for consumption by such a person in that part of the premises as an ancillary to his meal. For other purposes or in other parts of the premises the hours set out above shall continue to apply.
The above restrictions do not prohibit:
() during the first twenty minutes after the above hours the consumption of the alcohol on the premises;
() during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken away in an open vessel;
() during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as an ancillary to their meals;
() consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the premises;
() the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
() the sale of alcohol to a trader or club for the purposes of the trade or club;
() the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of Members of Her Majesty’s naval, military or air forces;
() the taking of alcohol from the premises by a person residing there; or
() the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
() the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the alcohol is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
2. Children in Bars
No person under fourteen shall be in the bar of the premises during the permitted hours (set out in condition 1 above) unless one of the following applies:
(1) He is the child of the holder of the premises licence
(2) He resides in the premises, but is not employed there
(3) He is in the bar solely for the purpose of passing to or from some part of the premises, which is not a bar and to or from which there is no other convenient means of access or egress
(4) The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
In the condition “bar” includes any place exclusively or mainly used for the consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
B) CONDITIONS REPRODUCING THE EFFECT OF CONDITIONS SUBJECT TO WHICH THE RELEVANT EXISTING LICENCE HAD EFFECT (PARAGRAPH 6(6) OF SCHEDULE 8 TO THE LICENSING ACT 2003).
JUSTICES' LICENCE
Special Hours Certificate - Cheshire Suite only
Subject to the following paragraphs, the special hours shall mean:
() On Fridays and Saturdays 19.00 to 01.00
The above special hours do not prohibit during the first thirty minutes after these hours the consumption of the alcohol on the premises.
During the special hours the sale of alcohol must be ancillary to the use of the premises for music and dancing and substantial refreshment.
PUBLIC ENTERTAINMENT LICENCE
1 Hours
The premise shall not (without the written consent of the Council) be opened or used for the licensed purposes except during the following days and hours:
() Cheshire Suite - Mondays to Saturday, 12.00 to 01.00
() Bridgewater Restaurant - Monday and Saturday, 12.00 to 00.00
2. Seasonal Variations
The premises shall not (without the written consent of the Council) be opened or used for the licensed purposes on Christmas Day.
The premises shall not (without the written consent of the Council) be opened or used for the licensed purposes on Good Friday except between the hours of 21.00 and midnight.
3. Permitted numbers
The maximum number of persons permitted to use the Premises at any one time shall not exceed the numbers below or such lesser number of persons as the Premises can with ample safety accommodate, having regard to the nature of the entertainment provided.
Cheshire Suite: The maximum number of persons permitted at any one time shall not exceed:
for all purposes 200 persons
Bridgewater Restaurant: The maximum number of persons permitted at any one time shall not exceed:
for all purposes 100 persons
4. Additional Conditions
Lobby to fire escape in the Cheshire Suite to be kept clear at all times.
Steps on all escape routes to be kept clear.
C) MANDATORY CONDITIONS
1. That no supply of alcohol may be made under the premises licence:-
() at a time when there is no designated premises supervisor in respect of the premises licence, or
() at a time when the designated premise supervisor does not hold a personal licence or his personal licence is suspended.
2. That every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
