• ANNEX 1 - MANDATORY CONDITIONS

   

  A)   CONDITIONS REPRODUCING THE EFFECT OF RESTRICTIONS IMPOSED ON THE USE OF THE PREMISES FOR THE EXISTING LICENSABLE ACTIVITES (PARAGRAPH 6(8) OF SCHEDULE 8 TO THE LICENSING ACT 2003)

   

  Permitted Hours

   

                Alcohol shall not be sold or supplied except during this licence authorises the carrying out of licensable activities

   

  The above restrictions do not prohibit:

  ()                 the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

  ()                 the sale of alcohol to a trader or club for the purposes of the trade or club;

  ()                 the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State, or an authorised mess of Members of Her Majesty’s naval, military or air forces.

   

  Consumption

               

                Alcohol shall not be sold in an open container or be consumed in the premises.

   

       MANDATORY CONDITIONS UNDER THE LICENSING ACT 2003

   

  1.  No supply of alcohol may be made under the premises licence:

  ()       at a time when here is no designated premises supervisor in respect of the premises licence, or

  ()       at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

   

  2.  (a) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

   

  (b) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

   

   

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  The prevention of crime and disorder

   

  CCTV

  There shall be a CCTV system installed that shall meet the requirements of a system that would be required to be registered under the Data Protection Act 1998.

   

  There shall be a member of staff available to use the CCTV equipment and provide the Police with a copy when requested.

   

  The protection of children from harm

   

  'Think 25'

  The premises shall operate a strict due diligence policy including 'Think 25' policy and all staff shall receive training in relation to the 'Think 25' policy, provisions of the Licensing Act 2003 and age restricted sales. Records of this training shall be kept at the store.

   

  The store shall operate a refusals book and also a due diligence recording system by way of the till. This is in relation to age restricted products, EPOS printouts to be kept where refusals of service are made.

   

  'Challenge 25'

  The premises shall adopt the principles of the 'challenge 25' scheme, whereby any person attempting to buy alcohol who appears to be under the age of 25 years, will be asked to provide proof of age. The accepted proof of age will be a Drivers Licence, passport or any other identity card which has a photograph of the holder, their date of birth and is PASS approved.

  All staff will receive training in relation to the 'challenge 25' scheme, contained in the companies 'to sell or not to sell' training package, a copy of which will be supplied to the Licensing Authority.

   

   

  All staff who are not Personal Licence Holders shall be authorised in writing and that authorisation shall be available for inspection at the premises.

   

  The company shall undertake internal test purchases.

   

  A scanning system shall be in place prompting staff to check the age of the customer when alcohol is purchased.

   

  Training

  All staff shall be trained to BIIAB level 1, with most staff being to BIIAB level 2.

  All staff shall receive 'in house' training on the sale of alcohol.

   

  Notices

  The premises shall display relevant warning notices advising customers that it is an offence for anyone 18 years, or over, to purchase alcohol on behalf of persons under 18 years of age.
