ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
. The prevention of harm to children:
Adoption of Challenge 21 policy and staff to be fully trained in its application. This is based on the fact that these premises have previously failed a trading standards test purchase.
Challenge 21 posters to be clearly displayed at the four points of sale - this will not only inform customers but will act as a reminder to staff.
3. To prevent crime & disorder:
CCTV system to be properly maintained and the images to be retained for a period of at least 28 days and shall be made available to Police for crime prevention and detection purposes.
Alcohol to be served as ancillary to food / meals taken in the form of a seated table meal in the (ground floor) restaurant (shown on plan 6) and (first floor?) market hall café area (shown on plan 8) and the ground floor bistro (shown on plan 7) to be consumed on the premises.
All drinks to be consumed within the area in which they were purchased.
Any sales of alcohol in restaurant and bistro in open containers must cease a minimum of 30 minutes prior to store closing time to allow for alcohol to be consumed.
Market hall café (first floor?) to close 30 minutes prior to store closing time to allow customers to make their way towards the tills and alcohol must cease to be served in Market Hall café a minimum of 30 minutes prior to market café closing time.
A separate point of sale for ‘Off’ sales of alcohol must only be made in the Swedish food market (shown as ‘Sweden shop’ on plan 7) with suitably trained adult staff with age related till prompts.
Although there is an anomaly in the time of the supply of alcohol on the Saturday (shown on section M of the application) and the time of closing (shown on section O). The text in section P would indicate that this is nothing more than a typing error and this has been treated as such.
4. Public Safety
Toughened glasses to be used to prevent injury.
No alcohol in open containers to be removed from ground floor restaurant, (first floor?) market hall café or bistro area’s.
OUTSIDE:
Police have great reservations about the whole of the car park area being used in the way described in paragraph 2 of section P.
This is a large open area with unrestricted access that is frequented by children of all ages. To have drink / alcohol / containers being allowed unfettered access to the whole of this area would be fraught with danger and send out a confusing drink / driving message. We believe such events can be dealt with by use of the T.E.N.’s and suitable control placed on events according to individual requirements at the time.
If the Licensing panel consider accepting the licensing of this area Police would seek the following controls;
1) All functions to be conducted from Marquee structures within clearly designated and roped off areas.
2) All alcohol to be served in plastic glasses
3) No alcohol to be taken out of the designated area
4) Staff conducting such promotions / functions should receive adequate training in licensing law.
