• ANNEX 1 - MANDATORY CONDITIONS

   

  A)   CONDITIONS REPRODUCING THE EFFECT OF RESTRICTIONS IMPOSED ON THE USE OF THE PREMISES FOR THE EXISTING LICENSABLE ACTIVITIES (PARAGRAPH 6(8) OF SCHEDULE 8 TO THE LICENSING ACT 2003).

   

  1        Permitted Hours

  Alcohol shall not be sold or supplied except during the times the licence authorises the carrying out of licensable activities.

   

  The above restrictions do not prohibit:

   

  ()                   consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the premises;

  ()                   the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;

  ()                   the sale of alcohol to a trader or club for the purposes of the trade or club;

  ()                   the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of Members of Her Majesty’s naval, military or air forces;

  ()                   the taking of alcohol from the premises by a person residing there; or

  ()                   the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or

  ()                   the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the alcohol is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

   

  2.      Children in Bars

  No person under fourteen shall be in the bar of the premises during the permitted hours (set out in condition 1 above) unless one of the following applies:

   

  (1)               He is the child of the holder of the premises licence

  (2)               He resides in the premises, but is not employed there

  (3)               He is in the bar solely for the purpose of passing to or from some part of the premises, which is not a bar and to or from which there is no other convenient means of access or egress.

  (4)                 The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.

   

  In the condition “bar” includes any place exclusively or mainly used for the consumption of alcohol.  But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.

   

  B)    MANDATORY CONDITIONS

   

  1.  Supply of Alcohol

  That no supply of alcohol may be made under the premises licence:-

  ()                   at a time when there is no designated premises supervisor in respect of the premises  licence, or

  ()                   at a time when the designated premise supervisor does not hold a personal licence or his personal licence is suspended.

  That every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  2.  Door Supervision

  Only individuals licensed by the Security Industry Authority shall be used at the premises to guard against:-

  (a)  unauthorised access or occupation (e.g. through door supervision), or

  (b)  outbreaks of disorder, or

  (c)  damage.

   

  C)   CONDITIONS REPRODUCING THE EFFECT OF CONDITIONS SUBJECT TO WHICH THE RELEVANT EXISTING LICENCE HAD EFFECT (PARAGRAPH 6(6) OF SCHEDULE 8 TO THE LICENSING ACT 2003).

   

  1        Public Entertainment Licence - Permitted numbers

  The maximum number of persons permitted to use the Premises at any one time shall not exceed for all purposes Friars Court 230 persons and FX 330 persons or such lesser number of persons as the Premises can with ample safety, accommodate having regard to the nature of the entertainment provided.

   

  2.  Public Entertainment Licence - Standard Conditions

  The Premises Licence is subject to all the standard conditions contained in the previous Public Entertainment Licence issued under the Local Government (Miscellaneous Provisions) Act 1982 as amended.

   

  3. Public Entertainment Licence - Schedule of Special conditions

  1                    The Premises Licence holder shall ensure that all the gates at each end of the courtyard at the premises are locked in the open  position at all times when premises are open to the public.

  2                    The Premises Licence holder shall ensure that the emergency door connecting both parts of the premises is not used except in any emergency or for disabled access and suitable signage is to be displayed in the vicinity of the access door.

  3                    The connecting door shall be continuously manned by door supervisors and other door supervisors to be deployed within the premises as shown on the plan deposited by the Premises Licence holder with the Local Authority.

  4                    The emergency exit doors at the side of the premises FX not to be used for any purposes other than emergency exit and suitable signage to be displayed in the immediate vicinity of the doors.

  5                    The window doors to the side of the FX buildings adjacent to the emergency exit to be   

              closed and secured by 23.00hrs each night. The music in the building to be so controlled by the Premises Licence holder to ensure that it is inaudible in the nearest noise sensitive building.

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Prevention of Crime and Disorder

   

  CCTV

  When CCTV is installed in the premises it shall comply with the Cheshire Constabulary Operational Guidlines for CCTV.

   

  Where CCTV equipment is fitted, it shall be maintained in good working order in accordance with the manufacturer’s instructions and shall be operational at all times when a licensable activity takes place on the premises.

   

  A written record shall be kept of images that are recorded by CCTV and shall include details of the recording medium used, the time and date recording commenced and finished.  The record shall identify the person responsible for the recording and shall be signed by him/her.  Where the recording is on a removable medium (i.e. videotape, compact disc, flash card etc), a secure storage system to store those recording mediums shall be provided.

   

  The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 31 days

   

  CCTV images shall be made available to the police or an authorised officer on request for crime prevention/detection purposes.  The Premises Licence holder or Designated Premises Supervisor shall ensure that there are sufficient staff trained on the premises who can download CCTV images at the time of a request to maximise the effectiveness of any police enquiry to detect and prosecute offenders.

   

  Door Supervisors

  Where any Door Supervisors are used at the premises they shall be registered with the Security Industry Authority.

   

  Where any person is employed on or about the Premises as a Door Supervisor the Premises Licence holder shall maintain a register in a form approved by the Licensing Authority showing in respect of each period of duty of that person:-

   

  (a)  the name, date of birth, badge or licence number and residential address of that person;

  (b)  the time at which he commenced the period of duty, with a signed acknowledgement by that person;

  (c)  the time at which he finished the period of duty, with a signed acknowledgement by that person;

  (d)  any time during the period of duty when he was not on duty; and

  (e)  if that person is not an employee of the Premises Licence holder, the name of the person by   whom that person is employed, or through whom the services of that person were engaged.

   

  The register shall be of hardback construction with consecutive numbered pages.

   

  The register shall be kept on the Premises at all times and shall be available for inspection by an authorised officer of the Licensing Authority or a Police Officer.

   

  The Premises Licence holder shall keep a log of all incidents that occur on the Premises.

   

  Door Supervisors shall be required to wear a reflective waistcoat to an approved standard.

   

  The reflective waistcoats shall:-

  1)  be a specified colour

  2)  have the approved "SECURITY" on the front and rear and

  3)  have a clear plastic pocket to display the SIA badge securely in a prominent position.

   

  Further details of the reflective waistcoat can be obtained from Cheshire Constabulary's Force Licensing Officer.

   

  Drink Promotions

  No sales promotions that encourage illegal, irresponsible or immoderate consumption shall be offered to customers.

   

  Open Bottles

  No customer carrying open or sealed bottles shall be admitted to the premises at anytime that the premises are open to the public.

   

  Standard Hours

  There shall be displayed on the premises a sign which is clearly visible to members of the public visiting the premises indicating the standard hours during which the sale of alcohol is permitted.

   

  Pubwatch

  The Premises Licence holder or their representative shall be an active member of the local pubwatch scheme.

   

  Removal of Drinks

  No person shall be allowed to remove drinks from the curtilage of the premises except in sealed containers.

   

  Search Policy

  The Premises Licence holder shall within one month put in place a search policy to cover both drugs and weapons for the premises, which shall be to the satisfaction of Cheshire Constabulary.  The Premises Licence holder shall then ensure that this search policy is complied with at all times when the premises are open for public entertainment.  Conspicuous notices advising customers of the search policy shall be displayed at all entrances to the premises.

   

  Toughened Glasses

  No drink shall be sold from a bar or by staff service or consumed in or on the premises other than in a container made form non-splintering plastic, paper or shatterproof glass.

   

  Bottle Bins

  There shall be provided on the premises bins for customers to place their empty bottles.

   

   

  Prevention of Public Nuisance

   

  Noise

  All doors and windows must be kept closed (except to allow ingress and exit) when any amplified or unamplified music or voices are being played within the premises.

   

  No nuisance shall be caused by noise or vibration coming from or transmitted through the structure of the buildings.  This includes any external plant or equipment attached to the premises or within the curtilage of the premises.

   

  The Premises Licence holder or their representative shall conduct regular assessments of the noise coming from the premises and shall take steps to reduce the level of noise where it is likely to cause disturbance to local residents.  A written record of those assessments and the remedial action taken shall be kept and will include the date, time of the checks and the name of the person carrying out the checks.  Details of the remedial action will also be recorded.

   

  When any live music is being played the premises shall be fitted with a noise-limiting device.  The activiation level of this device must be set and sealed by an officer of the Local Authority.

   

  No external speakers shall be used outside the building, this will include any beer garden or outside drinking area or car park.

   

  The use of any outside area will cease at 22.00.

   

  Refuse, including bottles, shall not be removed from the building for disposal between the hours of 23.00 and 07.00.

   

  Notices

  There shall be placed at all exits of the premises in a place where they can be seen and easily read by the public [or members and their guests] notices requiring customers to leave the premises quickly and quietly.  This condition also extends to car parks where car radios and members of the public may cause disturbance to local residents.

   

   

  Protection of children from harm

   

  Children

  No one under the age of 18 shall be allowed to enter or remain on the premises.

   

  Proof of Age Schemes - Challenge 21

  There shall be in place for the premises a written policy that employees challenge all persons purchasing alcohol who appear to be under 21 years of age.  That policy shall require any person who appears to be under the age of 21 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence, passport or accredited student card.

   

  Persons who appear to be under the age of 21 years shall be required to produce proof of age by way of a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence, passport or accredited student card.
