Additional Conditions

• ANNEX 1 - MANDATORY CONDITIONS

   

  (A) CONDITIONS REPRODUCING THE EFFECT OF RESTRICTIONS IMPOSED ON THE USE OF THE PREMISES FOR THE EXISTING LICENSABLE ACTIVITIES (PARAGRAPH 6(8) OF SCHEDULE 8 TO THE LICENSING ACT 2003).

   

  Children in Bars

  No person under fourteen shall be in the bar of the premises during the permitted hours unless one of the following applies:

   

  (1)               He is the child of the holder of the premises licence

  (2)               He resides in the premises, but is not employed there

  (3)               He is in the bar solely for the purpose of passing to or from some part of the premises, which is not a bar and to or from which there is no other convenient means of access or egress

  (4)   The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.

   

  In the condition “bar” includes any place exclusively or mainly used for the consumption of alcohol.  But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.

   

   

  (B)  CONDITIONS REPRODUCING THE EFFECT OF CONDITIONS SUBJECT TO

  WHICH THE RELEVANT EXISTING LICENCE HAD EFFECT (PARAGRAPH 6(6) OF

  SCHEDULE 8 TO THE LICENSING ACT 2003).

   

  1.  Public Entertainment Licence - Standard Conditions

  The Premises Licence is subject to the standard conditions contained in the previous Public Entertainment Licence issued under the Local Government (Miscellaneous Provisions) Act 1982 as amended  EXCLUDING:

  (1)   Condition 1.1 - Consent of the Council to open on Christmas Day & Good Friday;

  (2)   Conditions 39, 40.3 & 41 - Consent of the Council to provide pyrotechnics, smoke machines and lasers and strobe lighting.

   

  2.  Public Entertainment Licence Additional conditions

  The Premise Licensee holder shall put in place a search policy to cover both drugs and weapons for the premises which shall be to the satisfaction of Cheshire Constabulary.  The Premise Licence holder/Designated Premise Supervisor shall then ensure that this search policy is complied with at all times when the premises are open for licensable activities.  Conspicuous notices advising patrons of the search policy shall be displayed at all entrances to the premises.

   

  With the exception only of drinks which are available solely in glass bottles, the Premise Licence holder shall ensure that no drinks shall be sold from a bar or by staff service or otherwise be consumed in or on the premises other than in a container made from non-splintering plastic, paper or shatterproof glass.

   

  The Premise Licence Holder shall install within the public areas of the premises, a sufficient number of receptacles for the safe disposal of glass bottles by customers and staff.  These receptacles shall be maintained in good order and emptied on a regular basis.

   

  3.  Justices Licence

  1. Intoxicating liquor shall not be sold for consumption off the premises.

  2. Intoxicating liquor shall only be sold for consumption on the premises to persons:-

                (a) who have paid for admission; or

                (b) who attend private or pre-arranged functions; or

                (c) to whom complimentary tickets have been issued by the management; or

                (d) employed on the premises.

  3. Suitable beverages other than alcohol shall at all times be available on the premises.

   

   

  (C)  MANDATORY CONDITIONS

   

  Supply of alcohol   

  That no supply of alcohol may be made under the premises licence:-

  ()                   at a time when there is no designated premises supervisor in respect of the premises  licence, or

  ()                   at a time when the designated premise supervisor does not hold a personal licence or his personal licence is suspended.

  That every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Door Supervision

  Only individuals licensed by the Security Industry Authority shall be used at the premises to guard against:

   

  ()       unauthorised access or occupation (e.g. through door supervision), or

  ()       outbreaks of disorder, or

  ()       damage                                                                                                                                        

   

  Exhibition of films                                                                                    

  The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made by the British Board of Film Classification, where the film has been classified by that Board.

   

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  PREVENTION OF CRIME & DISORDER

   

  Drugs Policy

  The Premises Licence holder shall put in place a drugs policy for the premises.  The Premises Licence holder or other nominated person shall then ensure that this drugs policy is complied with at all times when the premises are open to the public.

   

  CCTV

  CCTV system shall comply with the Cheshire Constabulary Operating Requirements Document.

   

  Door Supervisors

  Where any Door Supervisors are used at the premises they shall be registered with the Security Industry Authority.

   

  Where any person is employed on or about the Premises as a Door Supervisor the Premises Licence holder shall maintain a register in a form approved by the Licensing Authority showing in respect of each period of duty of that person:-

           the name, date of birth, badge or licence number and residential address of that person;

           the time at which he commenced the period of duty, with a signed acknowledgement by that person;

           the time at which he finished the period of duty, with a signed acknowledgement by that person;

           any time during the period of duty when he was not on duty; and

           if that person is not an employee of the Premises Licence holder, the name of the person by whom that person is employed, or through whom the services of that person were engaged.

  The register shall be of hardback construction with consecutive numbered pages.

  Where I D Scan or better system is installed, the requirement to maintain a signing on register for door supervisors may be either in a hardback paper form as currently or electronically. The records (paper or electronic) shall be kept for a minimum of 2 years.

   

  The register shall be kept on the Premises at all times and shall be available for inspection by an authorised officer of the Licensing Authority or a Police Officer.

   

  The Premises Licence holder shall keep a log of all incidents that occur on the Premises.

   

  IDscan

  As soon as reasonably practicable and no later than 6 weeks from 13th March 2008 or such time as shall be agreed otherwise with the police and the Council the Premises Licence holder shall install and maintain a membership marketing, identification and age verifier such as IDscan or better, together with a camera which will provide a full face photograph which shall be stored and maintained by fully trained staff.

  Access to the database shall be provided to the police and authorised officers for purposes of crime prevention and detection.

   

  Pubwatch/Radio Scheme

  The Premises Licence holder or Designated Premises Supervisor shall be an active member of the local pubwatch scheme and participate in the pubwatch radio scheme.

   

   

  PUBLIC SAFETY

   

  Occupancy

  The maximum number of persons permitted to use the premises will be 1700 persons, being 1550 persons on the ground floor and 150 persons on the first floor.

   

  The Premises Licence holder shall have systems in place to ensure the occupany figures are not exceeded.

   

   

  PROTECTION OF CHILDREN FROM HARM

   

  Proof of Age Schemes - Challenge 21

  There shall be in place for the premises a written policy that employees challenge all persons purchasing alcohol who appear to be under 21 years of age.  That policy shall require any person who appears to be under the age of 21 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence, passport or accredited student card.

   

  Persons who appear to be under the age of 21 years shall be required to produce proof of age by way of a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence, passport or accredited student card.

   

  No children shall be permitted on the premises except for the under 16's disco, when no alcohol shall be on display.
