ANNEX 1 - MANDATORY CONDITIONS
A) CONDITIONS REPRODUCING THE EFFECT OF RESTRICTIONS IMPOSED ON THE USE OF THE PREMISES FOR THE EXISTING LICENSABLE ACTIVITIES (PARAGRAPH 6(8) OF SCHEDULE 8 TO THE LICENSING ACT 2003). Permitted Hours Alcohol shall not be sold or supplied except during the times this licence authorises the carrying out of licensable activities. The above restrictions do not prohibit: during the first twenty minutes after the above hours the consumption of the alcohol on the premises; during the first twenty minutes after the above hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken away in an open vessel; during the first thirty minutes after the above hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as an ancillary to their meals; consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the premises; the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered; the sale of alcohol to a trader or club for the purposes of the trade or club; the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of Members of Her Majesty’s naval, military or air forces; the taking of alcohol from the premises by a person residing there; or the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the alcohol is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises. Children in Bars No person under fourteen shall be in the bar of the premises during the permitted hours (set out in condition 1 above) unless one of the following applies: He is the child of the holder of the premises licence He resides in the premises, but is not employed there He is in the bar solely for the purpose of passing to or from some part of the premises, which is not a bar and to or from which there is no other convenient means of access or egress The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary. In the condition “bar” includes any place exclusively or mainly used for the consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals. B) MANDATORY CONDITIONS That no supply of alcohol may be made under the premises licence:- at a time when there is no designated premises supervisor in respect of the premises licence, or at a time when the designated premise supervisor does not hold a personal licence or his personal licence is suspended. That every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence |
B) CONDITIONS REPRODUCING THE EFFECT OF CONDITIONS SUBJECT TO WHICH THE RELEVANT EXISTING LICENCE HAD EFFECT (PARAGRAPH 6(6) OF SCHEDULE 8 TO THE LICENSING ACT 2003).
1 Public Entertainment Licence - Permitted numbers
The maximum number of persons permitted to use the Premises at any one time shall not exceed for all purposes 1450 persons or such lesser number of persons as the Premises can with ample safety, accommodate having regard to the nature of the entertainment provided.
2. Public Entertainment Licence - Seasonal Variations
The premises shall not (without the written consent of the Council) be opened or used for the licensed purposes on Good Friday [except between the hours of 21.00 to 00.00]
The premises shall not (without the written consent of the Council) be opened or used for the licensed purposes on Christmas Day
3. Public Entertainment Licence - Standard Conditions
The Premises Licence is subject to all the standard conditions contained in the previous Public Entertainment Licence issued under the Local Government (Miscellaneous Provisions) Act 1982 as amended.
4. Public Entertainment Licence Additional conditions
The Licensee shall within one month put in place a drugs policy for the premises which shall be to the satisfaction of Cheshire Constabulary. The Licensee shall then ensure that this drugs policy is complied with at all times when the premises are open for public entertainment.
The Premise Licensee holder shall put in place a search policy to cover both drugs and weapons for the premises which shall be to the satisfaction of Cheshire Constabulary. The Premise Licence holder/Designated Premise Supervisor shall then ensure that this search policy is complied with at all times when the premises are open for licensable activities. Conspicuous notices advising patrons of the search policy shall be displayed at all entrances to the premises.
With the exception only of drinks which are available solely in glass bottles, the Premise Licence holder shall ensure that no drinks shall be sold from a bar or by staff service or otherwise be consumed in or on the premises other than in a container made from non-splintering plastic, paper or shatterproof glass.
The Premise Licence Holder shall install within the public areas of the premises, a sufficient number of receptacles for the safe disposal of glass bottles by customers and staff. These receptacles shall be maintained in good order and emptied on a regular basis.
Justices Licence
1. Intoxicating liquor shall not be sold for consumption off the premises.
2. Intoxicating liquor shall only be sold for consumption on the premises to persons:-
(a) who have paid for admission; or
(b) who attend private or pr arranged functions; or
(c) to whom complimentary tickets have been issued by the management; or
(d) employed on the premises.
3. Suitable beverages other than alcohol shall at all times be available on the premises.
4. No temporary events shall be granted under the authority of this licence.
