Additional Conditions

ANNEX 1 - MANDATORY CONDITIONS

A)              CONDITIONS REPRODUCING THE EFFECT OF CONDITIONS SUBJECT TO WHICH THE RELEVANT EXISTING LICENCE HAD EFFECT (PARAGRAPH 6(6) OF SCHEDULE 8 TO THE LICENSING ACT 2003).

1        Public Entertainment Licence - Seasonal Variations
The premises shall not (without the written consent of the Council) be opened or used for the licensed purposes on Good Friday except between the hours of 21.00 to 00.00.

The premises shall not (without the written consent of the Council) be opened or used for the licensed purposes on Christmas Day.

2        Public Entertainment Licence - Permitted numbers
The maximum number of persons permitted to use the Premises at any one time shall not exceed for all purposes 100, or such lesser number of persons as the Premises can with ample safety, accommodate having regard to the nature of the entertainment provided.

3.   Public Entertainment Licence - Standard Conditions
The Premises Licence is subject to all the standard conditions contained in the previous Public Entertainment Licence issued under the Local Government (Miscellaneous Provisions) Act 1982 as amended.

B)    MANDATORY CONDITIONS UNDER THE LICENSING ACT 2003

Alcohol
1. That no supply of alcohol may be made under the premises licence:-
()                   at a time when there is no designated premises supervisor in respect of the premises licence, or
()                   at a time when the designated premise supervisor does not hold a personal licence or his personal licence is suspended.

2. That every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

Door Supervision
Only individuals licensed by the Security Industry Authority shall be used at the premises to guard against:

()       unauthorised access or occupation (e.g. through door supervision), or
()       outbreaks of disorder, or
()       damage

Exhibition of films
The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made by the British Board of Film Classification, where the film has been classified by that Board.
ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

PREVENTION OF CRIME & DISORDER

Door Supervision
Where the Premises Licence holder considers using door supervisors he shall seek advice from Cheshire Constabulary as to the number considered sufficient to control the entry of persons to the premises and for keeping of order in the premises when they are used for a licensable activity.

Pubwatch
The Premises Licence holder or their representative shall be an active member of the local pubwatch scheme.

Text and/ or Radio Pagers
Where already used, any text and/or radio pagers shall be used for any addional hours.

Containers
Toughened glass is currently in use and will continue to be used during any additional hours.

Drinks Promotions
In line with the Premises Licence holder's Alcohol and Social Responsibility policy there shall be no promotions that encourage illegal, irresponsible or immoderate consumption.

CCTV
Where CCTV equipment is fitted, it shall be maintained in good working order in accordance with the manufacture’s instructions and shall be operational at all times when licensable activities are taking place on the premises.

PREVENTION OF PUBLIC NUISANCE

Noise
There shall be place at all exits from the premises prominent, clear and legible notices that can be easily read by the public requiring customers to leave the premises and the area quietly.

PROTECTION OF CHILDREN FROM HARM

Proof of Age Schemes
There shall be in place for the premises a written policy that employees challenge all person purchasing alcohol who appear to be under 18 years if age. Person who appear to be under the age of 18 shall be required to produce proof of age by way of a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) or if a proof of age card is not available a photo driving licence or passport.

Adult Entertainment
No adult entertainment of a nude physical nature (paid for by the Premises Licence holder) shall be permitted at the premises.

Children
Children under the age of 16 years of age shall remain the responsibility of the accompanying adult when using the premises.
